ACCOMMODATION BOOKING TERMS
1. Scope and contracting party
These Terms govern accommodation reservations made through this public booking Website. The reservation contract is concluded between the customer named in the reservation (the Customer) and the CoastVenture group company determined by the country in which the booked accommodation is located, in accordance with the following allocation (the Booking Entity):
- Spain, Germany or Uruguay: COASTVENTURE S.L., NIF B56309883, registered office at Avda. de Bruselas 20, Local 221, Centro Comercial Fañabé Plaza, 38660 Adeje, Santa Cruz de Tenerife, Spain;
- Austria: COASTVENTURE GmbH, Czerninplatz 4, 1020 Vienna, Austria; VAT-ID ATU78663037.
- Croatia: COASTVENTURE DOO, Petra Hektorovića Str. 2, 10000 Zagreb, Croatia; MBS 081639335; OIB 28240983208; VAT-ID HR28240983208.
- Bulgaria: COASTVENTURE EOOD, Hristo Belchev Str. 44, 1000 Sofia, Bulgaria; EIK 206932141; VAT-ID BG206932141.
Common reservation contact for every Booking Entity: reservations@coastventure.com; telephone +34 822 110 843.
The Booking Entity accepts and administers the reservation and payment and issues the invoice to the Customer in its own name. The accommodation service may be performed by the property-specific operator; this does not alter the Booking Entity's position as the Customer's contracting and invoicing party for the reservation.
2. Reservation
The selected accommodation, stay dates, occupancy, Total Price, rate and cancellation conditions and the reservation confirmation form part of the reservation contract. The reservation becomes binding when the required payment has been successfully processed and the Booking Entity issues the reservation confirmation.
The Customer must verify the reservation details and promptly notify the Booking Entity of any error. The Terms and rate conditions accepted when the reservation is completed continue to govern that reservation; any later amendment applies only to future reservations.
3. Tourist accommodation and property-specific conditions
The accommodation may be occupied whether the trip is for leisure or work, but the booking remains a tourist-accommodation service for the confirmed dates and is not a residential or seasonal lease or a means of satisfying a habitual or permanent housing need.
The listing and pre-payment reservation summary identify, as applicable, the accommodation category, tourist licence or registration number, maximum occupancy, included services, access conditions, check-in and check-out times and applicable house rules. The reservation confirmation records those details, which form part of the reservation contract.
4. Price, payment, cancellation and withdrawal
The total price displayed before payment (the Total Price) includes all applicable taxes, including local Value Added Tax and tourism taxes where applicable, and all mandatory charges payable for the booked service. If a mandatory component cannot reasonably be calculated in advance or must by law be paid locally, its nature, calculation method, payee and payment timing are disclosed before booking. Optional services and amounts payable for loss, damage or breach are charged separately only where applicable.
Payment timing, cancellation, amendment, no-show and refund conditions are those displayed before the reservation is completed and stated in the reservation confirmation.
Where the Customer is a consumer, the statutory right of withdrawal applicable to distance contracts does not apply to accommodation services provided for specified dates. This does not affect the agreed cancellation rights or any mandatory consumer remedy.
5. Check-in and use
The required identity, guest-registration and check-in information must be completed before access instructions are released. Only registered guests may occupy the accommodation and the stated maximum occupancy must be respected.
Guests must comply with the applicable house rules and must not assign or sublet the accommodation, hold parties, cause unreasonable disturbance or use it for an unlawful purpose. The Customer is responsible for the conduct of the registered guests and for loss or damage caused by them beyond fair wear and tear.
6. Inability to provide the accommodation
If the booked accommodation cannot be provided, the Booking Entity will offer a reasonably equivalent alternative for the Customer's acceptance or refund the amounts paid for the affected accommodation service. This does not limit any remedy required by mandatory law.
7. Privacy, assistance, complaints, applicable law and jurisdiction
Personal data is processed in accordance with the applicable Privacy Notice. Reservation assistance and complaints concerning booking, payment or invoicing may be submitted to reservations@coastventure.com. The accommodation operator's local assistance details are stated in the listing, reservation confirmation or check-in information.
Official complaint forms or the equivalent procedure are available from the accommodation operator where required by applicable law. For accommodation in the Canary Islands, official tourism complaint forms are available from the relevant accommodation operator in the form required by applicable law.
These Terms and the reservation are governed by the law of the country in which the Booking Entity has its registered office, together with any mandatory tourism and accommodation rules applicable at the property's location, without depriving consumers of any mandatory protection available under the law of their habitual residence. Jurisdiction shall be determined in accordance with applicable mandatory law.
